Goal: Development of Mechanism for resolution of farm debts, utilization of TPAC mechanism for protection of dehkans’ rights while resolving farms’ debts.

What mechanisms are being worked-off: 1. Restructuring of debt The legal basis of farms debts formation, succession, economic potentials of farms to liquidate debts are being explored Result: Proposal of improving the functions of the Independent Commission, restructuring of debts, reorganizing and regulating of contractual relationship between cotton producers and exporters are developed and handed over to the Independent Commission.
2.Farm bankruptcy Possibilities of bankruptcy of pilot farms and procedures of its conduct is being determined. Result: Financial condition of farms, burden of debts, possibilities of pay back in middle term prospect, legal basis for conducting bankruptcy procedures are being analysed.
3. Protection of constitutional right of citizens to land The majority of members of dehkan farms, who have plots of land in disposal based on land certificates, do not know their rights on the plot. Result: Normative base for the right to life-long use of land is being analysed, the draft amendments to the “Law on Dehkan farms” and other laws and normative acts regulating procedure of life-long use of land and succession are being developed.
Planned result: Restructuring of debts and their reduction up to minimum.
Project direction: Preparation of documents, regulating the activity of an Independent Commission; Working-off mechanism for restructuring of debts in pilot farms; Development of legal bases for restructuring of debts; Development of legal and legislative draft acts on issues with regard to the agriculture reforming, which would prevent emerging of debts in cotton-growing farms
